Job description

Staffline are working in partnership with the Northern Ireland Civil Service to recruit 2 x temporary Legal Assistants (DP) to start ASAP for a duration of 3-6 Months (initially)

Pay rate: 0-12 week's £12.00pr hour

13+ week's £19.76pr hour

Location: Belfast, BT2

Hours: Mon - Fri (9.00am -5.00pm) - 37.5hrs per week

Essential Criteria

  • Possess at least a 2.2 Honors degree in law; and
  • Be a solicitor or barrister entitled to practice in Northern Ireland

Purpose

The primary purpose of the post is to work with the DP Lawyer within the Exceptionality & Criminal Authorities Team in the management of applications from practitioners for Certificates of Exceptional Preparation Time in criminal proceedings - both Magistrates Courts and Crown Court.

The Agency's governing legislation for criminal legal aid provides for practitioners to seek certificates of exceptionality in criminal proceedings for which they consider that the standard fees structure does not provide fair and reasonable remuneration. Such applications are considered against the statutory criteria for same, with the Agency having the remit to grant such applications, refuse applications, or grant additional hours, which are less than those sought.

The legislation also provides for the practitioner to maintain and submit to the Agency regular reports on the work carried to date against the certificate of exceptionality that is in place; failure to do so may result in that certificate being revoked and the fees payable thereafter will be accordance with the standard fees payable in the proceedings.

Main Duties

Working alongside DP/Lawyer colleagues the post holder is responsible for:

Management and co-ordinating the over programme of work associated with applications and grants of exceptional preparation time - working to established performance targets

Adjudicating upon applications for exceptional preparation against the statutory criteria (advice and guidance available from Business Manager)

Ensuring that the system for management of the practitioner's contemporaneous records in accordance with the statutory criteria operates effectively; bringing forward recommendations for the revocation of certificates if appropriate in a timely manner.

Considering requests for expert witnesses and other disbursements in proceedings where certificates of exceptionality have been granted.

At the conclusion of proceedings, the assessment of the practitioner's fees in accordance with the certificate of exceptionality that is in place.

Contributing to LSANI's financial forecasting fora by providing accurate and up to date information in respect of the financial liabilities being accrued across the certificates that are in place; including early identification of expenditure trends.

Successful applicants will be required to undertake an Access NI Disclosure check at a cost of £18/£33. A person's criminal record will not, in itself, debar that person from being appointed to this post. Any information given will be treated in the strictest confidence.
